Lump sum death benefits

A person who meets the dependency criteria set out in the Motor Accidents (Compensation) Act 1979 may be entitled to receive lump sum death benefits.


Who is entitled to lump sum death benefits?

If a dependant meets the criteria set out in the Motor Accidents (Compensation) Act 1979, they may be entitled to receive lump sum death benefits as follows:


  • Surviving spouse or de facto partner with no dependent children
    A lump sum death benefit entitlement may be paid to the surviving spouse or de facto. 


  • Surviving spouse or de facto partner with dependent children
    The lump sum death benefit is shared by the surviving spouse or de facto partner and dependent children. Depending on the number of dependent children, they will each receive a percentage of the total lump sum death benefit. This money will be held by the Public Trustee and become available when the child reaches 18 years of age. 


  • Surviving dependent children only
    The lump sum death benefit is shared between dependent children and is held by the Public Trustee and becomes available when each child reaches 18 years of age. 


  • No surviving spouse, de facto or dependent children
    If there is no surviving spouse, de facto or dependent children, a parent who lived with the deceased and was financially dependent upon them, may be entitled to receive the lump sum death benefit.

Amount of lump sum death benefits

Death benefits are calculated at 156 times the average weekly earnings for the Northern Territory as published by the Australian Statistician.

How to make a fatality claim

You can make a claim by downloading and completing a fatality claim form. Fatality claim forms are also available from hospitals in the NT.   If you would like a claim form sent to you in the mail, please call the TIO MAC claims team on 1300 493 506 during business hours.

Next steps

After we have received your completed claim form, you will receive written notification from TIO MAC which will include your claim number and the name and contact details of your TIO MAC case manager.


Your case manager will be your first contact for managing your claim.  They will call you to introduce themselves, answer any questions you may have and guide you through the claims process. If there is any further information we require, your case manager will let you know. 


If you haven’t heard from TIO MAC after 5 business days, please contact TIO on 1300 493 506 to make sure your claim has been received.
