TIO and the law firms it engages, must act as model litigants in accordance with the MACC model litigant principles.

As the MAC Scheme claims manager, TIO and any law firms acting on its behalf, are required to uphold the highest ethical and professional standards by acting honestly and fairly through the claims and litigation processes. They must act consistently with MACC's Model Litigant Principles when managing claims, disputes or litigation. 


MACC Model Litigant Principles


  • Deal with legal matters promptly, not causing unnecessary delays
  • Avoid court proceedings where possible by making appropriate and timely decisions and payments where it is clear that liability is at least as much as the amount to be paid 
  • Act consistently and fairly in the handling of court proceedings
  • If there is no doubt regarding the truth of a matter, do not dispute it
  • If there is no doubt concerning liability, do not dispute it
  • Do not take unfair advantage of a claimant who lacks the resources to litigate a legitimate claim
  • Utilise a defence that will provide a fair and streamlined approach to address the fundamental legal issues including participating in appropriate alternative dispute resolution (ADR) processes or settlement negotiations in good faith
  • Only pursue appeals that have reasonable prospects for success, or the appeal is justified in the public interest 
  • Apologise if aware of actions that are wrongful or improper


Obligations do not prevent taking appropriate steps to pursue litigation or defending claims made against the MAC Scheme, or from pursuing the recovery of costs in appropriate cases.
